FAN TERMS AND CONDITIONS OF SERVICE

PLEASE READ THESE TERMS CAREFULLY. BY CREATING AN ACCOUNT, SUBSCRIBING TO ANY CREATOR, OR MAKING ANY PAYMENT THROUGH THE FANFLOW PLATFORM, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS IN THEIR ENTIRETY.

PREAMBLE

These Fan Terms and Conditions of Service ("Agreement" or "Fan Terms") constitute a legally binding contract between FanFlow, Inc. and/or FanFlow Holdings, LLC (collectively, "FanFlow," "Company," "we," "us," or "our") and any individual who accesses the FanFlow platform as a subscriber, viewer, tipper, or other consumer of creator content ("Fan," "Subscriber," "you," or "your").

These Fan Terms govern your access to and use of the FanFlow platform, including fanflow.com, any associated mobile applications, and all related services (collectively, the "Platform"). They should be read alongside FanFlow's Privacy Policy, Community Guidelines, and any other policies incorporated by reference.

These Fan Terms are distinct from the Creator Terms and Conditions, which govern individuals who publish content on the Platform. If you are both a Fan and a Creator, both sets of terms apply to you in their respective capacities.

FanFlow operates as a technology platform that facilitates the relationship between Creators and their fans. FanFlow is not a publisher, broadcaster, talent agency, or entertainment provider. All content accessible through the Platform is generated exclusively by independent Creators, and FanFlow assumes no editorial responsibility for that content.

SECTION 1: DEFINITIONS

The following terms have the meanings set out below throughout these Fan Terms:

1.1 "Platform" means the FanFlow website at fanflow.com, associated subdomains, mobile applications, APIs, and all related services operated by FanFlow, Inc.

1.2 "Fan" or "Subscriber" means any User who accesses, views, or financially supports a Creator's content through any mechanism, including paid subscriptions, tips, pay-per-view purchases, or bundle subscriptions.

1.3 "Creator" means an independent individual or entity that has registered an account on the Platform to publish, distribute, or sell content to Fans.

1.4 "Creator Content" or "Content" means any text, photographs, video recordings, audio, livestreams, graphics, messages, or any other material published by a Creator on the Platform.

1.5 "Subscription" means a recurring monthly payment made by a Fan to a Creator or Bundle in exchange for access to that Creator's or Bundle's content tier.

1.6 "Bundle" means a multi-Creator subscription package where two or more Creators collectively offer their content under a single subscription price.

1.7 "Platform Fee" means the percentage of gross revenue retained by FanFlow from subscription and transaction proceeds.

1.8 "Payment Processor" means the third-party payment processing service used by FanFlow to process Fan payments, currently Stripe or such other processor as FanFlow may designate.

1.9 "Tip" means a voluntary, non-refundable one-time payment made by a Fan to a Creator as a gratuity.

1.10 "Pay-Per-View" or "PPV" means a one-time payment made by a Fan to access a specific piece of Creator Content outside of a standard subscription tier.

1.11 "Prohibited Conduct" means any conduct by a Fan that violates these Fan Terms, the Community Guidelines, or applicable law.

1.12 "After Dark" means FanFlow After Dark (fanflowafterdark.com), a separate adult content platform operated by FanFlow Media LLC, subject to additional supplemental terms.

1.13 "Chargeback" means a reversal of a transaction initiated by a Fan through their bank or payment card issuer.

1.14 "Personal Information" has the meaning given to it in the Privacy Policy.

SECTION 2: ACCEPTANCE OF TERMS AND ELIGIBILITY

2.1 Acceptance

By creating a Fan account, subscribing to any Creator, making any payment through the Platform, or simply browsing logged-in areas of the Platform, you unconditionally and irrevocably accept these Fan Terms. If you do not agree to these Fan Terms, you must not use the Platform.

2.2 Age Requirement

You must be at least eighteen (18) years of age to create an account or use the Platform in any capacity. By creating an account or using the Platform, you represent and warrant that you are at least 18 years old. FanFlow reserves the right to verify your age at any time and to terminate your account if age verification cannot be completed. Access to FanFlow After Dark requires additional age verification steps including government-issued photo ID. See Section 18 for details.

2.3 Legal Capacity

You represent and warrant that you have full legal capacity to enter into binding contracts; you are not prohibited by law from accessing the Platform; and your use of the Platform complies with all applicable laws in your jurisdiction, including laws governing the purchase of digital content and adult-oriented material.

2.4 Minors Strictly Prohibited

The Platform is strictly prohibited for persons under 18 years of age. If FanFlow discovers or suspects an account is being used by a minor, it will immediately terminate the account and take such further action as required by law. Parents or guardians who become aware that a minor has accessed the Platform should contact FanFlow immediately at safety@fanflow.com.

2.5 Geographic Restrictions

Access to certain features may be restricted based on your geographic location due to legal requirements, content classification laws, or payment processor limitations. You are responsible for ensuring your use of the Platform complies with the laws of your country, state, or territory.

SECTION 3: ACCOUNT REGISTRATION AND SECURITY

3.1 Account Creation

To access paid content on the Platform, you must register for a Fan account. You agree to provide accurate, current, and complete information at registration; maintain and update your account information as necessary; not impersonate any person; and not create an account if you have previously been banned from the Platform.

3.2 Account Security

You are solely responsible for maintaining the security and confidentiality of your account login credentials. You must use a strong, unique password; enable two-factor authentication where offered; not share your login credentials with any other person; and notify FanFlow immediately at security@fanflow.com if you become aware of any unauthorised access. FanFlow shall not be liable for any loss or damage arising from your failure to maintain adequate account security, including unauthorised subscriptions, tips, or purchases made through your account.

3.3 Account Responsibility

You are responsible for all activity that occurs under your account, whether or not authorised by you. If you believe your account has been compromised, you must change your password immediately and contact FanFlow support.

3.4 One Account Per Fan

Each Fan may maintain only one account. Creating multiple accounts to circumvent suspensions, bans, or to obtain promotional offers multiple times is prohibited and will result in permanent termination of all associated accounts.

SECTION 4: FAN CONDUCT AND OBLIGATIONS

4.1 General Code of Conduct

By using the Platform, you agree to treat all Creators and other Users with dignity and respect. You must not harass, threaten, or abuse any Creator or User; post discriminatory or hateful content; attempt to manipulate or coerce Creators; contact Creators in a manner that could constitute stalking; or attempt to extract personal contact details from Creators through the Platform.

4.2 Prohibited Fan Activities

The following activities are strictly prohibited and will result in immediate account termination:

Downloading, recording, screen-capturing, or reproducing Creator Content for any purpose other thanprivate viewing;

Distributing, sharing, re-uploading, selling, or commercialising any Creator Content without the Creator'sexpress written permission;

Sharing your account login with others to allow access to paid content without payment;

Initiating fraudulent, false, or unwarranted payment chargebacks or disputes;

Using the Platform to solicit Creators for services designed to circumvent FanFlow's fees;

Attempting to bribe or financially induce a Creator to produce content that violates these Terms or applicablelaw;

Using automated tools, bots, or scripts to access the Platform or scrape content;

Using the Platform to commit fraud, including providing false payment information or using stolencredentials.

4.3 Prohibition on Content Redistribution

You expressly acknowledge that Creator Content is protected by copyright; your subscription grants only a personal, non-transferable licence to view content for private use; any redistribution without authorisation constitutes copyright infringement and may expose you to civil and criminal liability; and FanFlow actively monitors for unauthorised redistribution and will cooperate with law enforcement in response to such activity.

4.4 Communication with Creators

All communications through the Platform must be lawful, respectful, and consistent with these Terms. You must not send unsolicited sexual or intimate messages; threaten, blackmail, or coerce a Creator; demand refunds or personal contact information; or use messaging to advertise external products or platforms.

4.5 Reporting Obligations

If you become aware of Content that violates these Terms, applicable law, or poses a risk of harm, you are encouraged to report it using the Platform's reporting tools or by emailing trust@fanflow.com. Making false or malicious reports that you know to be unfounded is itself a violation of these Fan Terms.

SECTION 5: SUBSCRIPTIONS AND PAYMENTS

5.1 Subscription Model

Subscriptions are offered on a recurring monthly basis unless otherwise stated. By subscribing, you authorise FanFlow and its Payment Processor to charge your nominated payment method on a recurring basis at the applicable rate until you cancel.

5.2 Subscription Pricing

Subscription prices are set by individual Creators and may vary. Prices are displayed in USD unless otherwise indicated. Exchange rate fluctuations are outside FanFlow's control.

5.3 Billing Cycle

Your subscription renews automatically at the end of each monthly billing period on the same date as your initial subscription. FanFlow will endeavour to send a reminder before renewal charges are processed, but is not obligated to do so.

5.4 Payment Methods

By providing a payment method, you represent that you are the authorised account holder; the payment information is accurate and complete; and you will promptly update your payment information if it changes.

5.5 Failed Payments

If a payment fails, FanFlow may attempt to re-process the payment multiple times. If payment cannot be successfully processed, your access to the relevant Creator's content may be suspended until payment is resolved. FanFlow is not responsible for content missed during a period of suspended access due to payment failure.

5.6 Tips and Pay-Per-View

Tips are entirely voluntary and non-refundable. By sending a tip, you acknowledge you are making a gift to the Creator and have no entitlement to any content or service in return. Pay-per-view purchases grant a one-time personal licence to view the specified content. Both are final and non-refundable except as provided in Section 7.

5.7 Bundle Subscriptions

Bundle subscriptions provide access to content from multiple Creators at a bundled price. Revenue allocation among participating Creators is governed by the Bundle Revenue Split Agreement and is not subject to Fan input. A Fan's subscription to a Bundle does not create any direct contractual relationship with individual Creators in that Bundle.

5.8 Price Changes

Creators may change their subscription prices. Notice of price increases will be provided before your next renewal date. If you do not wish to pay the new price, you must cancel before the renewal date on which the new price takes effect. Continued subscription constitutes acceptance of the new price.

5.9 Promotional Offers

Promotional terms are subject to the specific conditions communicated at the time of the offer. Free trials automatically convert to paid subscriptions at the end of the trial period unless cancelled. Each promotional offer may only be used once unless explicitly stated otherwise.

5.10 Currency and Taxes

You are responsible for any taxes applicable to your subscription or purchases in your jurisdiction. FanFlow may be required to collect applicable sales tax, GST, or VAT, which will be added to the displayed price at checkout.

SECTION 6: CANCELLATION POLICY

6.1 Cancellation by Fan

You may cancel your subscription to any Creator at any time through your account dashboard under "Manage Subscriptions." Cancellation is effective at the end of the current billing period. You retain access to the Creator's content until the last day of your paid period.

6.2 No Pro-Rata Refunds on Cancellation

Unless otherwise required by law or provided in the Refund Policy (Section 7), cancelling your subscription does not entitle you to a pro-rata refund of any portion of your current billing period.

6.3 Cancellation Process

To cancel: log in to your Fan account; navigate to your Account Dashboard; select "Subscriptions" and locate the relevant Creator or Bundle; select "Cancel Subscription" and confirm. FanFlow will send an email confirmation. If you do not receive confirmation, please contact support@fanflow.com.

6.4 Reactivation

You may reactivate a cancelled subscription at any time. Reactivation begins a new billing cycle and the price at the time of reactivation applies, which may differ from your original price.

6.5 Creator Account Termination

If a Creator's account is terminated by FanFlow, your subscription will be cancelled and you may be entitled to a pro-rata refund of unused subscription fees, depending on the reason for termination. FanFlow will communicate any applicable refund entitlement to affected Fans.

SECTION 7: REFUND POLICY

7.1 General Non-Refundability

All payments made through the Platform are generally non-refundable. This includes subscription payments, tips, and pay-per-view purchases. You should consider all purchases carefully before completing them.

7.2 Eligible Refund Circumstances

Notwithstanding Section 7.1, FanFlow may in its discretion issue a refund in the following limited circumstances:

FanFlow terminated the Creator's account for a material breach of the Creator Terms, and your currentbilling period extends beyond the termination date;

A technical error attributable to FanFlow's systems resulted in a duplicate or incorrect charge;

You were charged after properly cancelling a subscription prior to your renewal date, due to an error inFanFlow's billing systems;

A transaction was made by an unauthorised third party without your knowledge, and you have not materiallycontributed to that unauthorised access;

Applicable consumer protection laws in your jurisdiction require a refund.

7.3 Refund Exclusions

Refunds will not be issued if you are dissatisfied with Creator Content; did not read the Creator's profile before subscribing; forgot to cancel before renewal; made a tip and later changed your mind; purchased and viewed pay-per-view content; the Creator temporarily reduced posting frequency; or you forgot to cancel a free trial before conversion.

7.4 Refund Request Process

To request a refund, submit a request to refunds@fanflow.com within thirty (30) days of the relevant charge, including: your registered email and username; the date and amount of the charge; the Creator or Bundle involved; and a description of the circumstances. FanFlow will review requests within 14 business days.

FanFlow's decision is final.

7.5 Chargebacks

You agree not to initiate a chargeback unless you have first submitted a refund request through FanFlow's official process and received a final response. Initiating a bad-faith chargeback may result in: immediate account suspension or termination; recovery of the disputed amount from outstanding FanFlow credits; FanFlow sharing evidence of your transaction with your bank to contest the chargeback; and legal action for breach of contract.

7.6 Statutory Consumer Rights

Nothing in this Refund Policy limits or excludes any rights you may have under applicable consumer protection laws in your jurisdiction.

SECTION 8: CONTENT ACCESS AND INTELLECTUAL PROPERTY

8.1 Limited Licence to View Content

Your subscription or payment grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable licence to access and view Creator Content for your own private, non-commercial enjoyment only. This licence does not include the right to download or copy Content; reproduce, distribute, or publicly display Content; create derivative works; use Content for any commercial purpose; or use Content in AI training datasets or generative AI systems.

8.2 Ownership of Creator Content

All Creator Content is owned by the Creator who produced it. Your payment does not transfer any Intellectual Property Rights to you. FanFlow likewise makes no claim of ownership over Creator Content. You have no rights in Creator Content beyond the limited viewing licence in Section 8.1.

8.3 FanFlow Platform Rights

All Intellectual Property Rights in the Platform itself — including its technology, software, interface, design, branding, and trademarks — are owned exclusively by FanFlow or its licensors. You must not use, copy, adapt, or commercialise any aspect of the Platform or FanFlow's brand without prior written consent.

8.4 Copyright Infringement by Fans

If you redistribute or publish Creator Content without authorisation, you may be liable to the Creator for copyright infringement. FanFlow may provide Creator details and transaction records to law enforcement or rights holders in connection with infringement claims against you.

8.5 User-Generated Content

If you post any content on the Platform — including comments, reviews, or messages — you grant FanFlow a non-exclusive, worldwide, royalty-free licence to use and display such content in connection with operating the Platform. You retain ownership of original content you post but represent that it does not infringe any third party's rights.

SECTION 9: PRIVACY AND DATA

9.1 Privacy Policy

FanFlow's collection, use, storage, and disclosure of your Personal Information is governed by the FanFlow Privacy Policy, incorporated into these Fan Terms by reference. By using the Platform, you consent to the practices described in the Privacy Policy.

9.2 Information Collected

In the course of your use of the Platform, FanFlow may collect: registration information (name, email, date of birth); payment information (processed and stored by our Payment Processor); subscription and transaction history; device information, IP address, and usage data; communications sent through the Platform; and age verification information where required.

9.3 Data Use

FanFlow uses your data to operate the Platform, process payments, send transactional communications, improve the user experience, comply with legal obligations, and enforce these Terms. FanFlow does not sell your Personal Information to third-party advertisers.

9.4 Payment Data Security

All payment card data is processed by our Payment Processor (Stripe) and is not stored directly by FanFlow. FanFlow stores only a tokenised reference to your payment method and implements industry-standard TLS encryption for data in transit.

9.5 Subscription Privacy

FanFlow will not disclose your subscription history to third parties except as required by law, in connection with a legitimate dispute, or as described in the Privacy Policy. Creators will see you as a subscriber but will not access your full legal name, payment details, or other identifying information beyond your chosen display name, unless you choose to share such information.

9.6 Your Data Rights

Depending on your jurisdiction, you may have rights to access, correct, delete, or restrict processing of your Personal Information. To exercise these rights, contact privacy@fanflow.com.

9.7 Data Retention

FanFlow retains your account and transaction data for a minimum of seven (7) years from the date of each transaction, or such longer period as required by law, for purposes including tax compliance, fraud prevention, and legal proceedings.

SECTION 10: FANFLOW'S ROLE AND LIMITATION OF LIABILITY

10.1 FanFlow as a Technology Platform

FanFlow is a technology platform that facilitates the distribution of content from Creators to Fans. FanFlow is not the author, producer, editor, or publisher of any Creator Content. Creators are independent third parties solely responsible for their content.

10.2 No Guarantee of Content Quality

FanFlow makes no representations or warranties regarding the quality, accuracy, completeness, legality, or suitability of any Creator Content. FanFlow does not endorse any Creator or any views expressed in Creator Content. Your decision to subscribe to a Creator is made at your own discretion and risk.

10.3 No Guarantee of Creator Activity

FanFlow does not guarantee that any Creator will post content on any particular schedule or remain active on the Platform. If a Creator becomes inactive, your recourse is to cancel your subscription.

10.4 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED ON AN

"AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND. FANFLOW

EXPRESSLY DISCLAIMS ANY WARRANTY THAT THE PLATFORM WILL BE UNINTERRUPTED OR

ERROR-FREE; ANY WARRANTY AS TO THE ACCURACY OR RELIABILITY OF CREATOR CONTENT; ANY

IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE; AND ANY WARRANTY THAT THE PLATFORM WILL MEET YOUR EXPECTATIONS.

10.5 Limitation of FanFlow's Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FANFLOW SHALL NOT BE LIABLE FOR

ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF DATA OR

ACCESS TO CONTENT; HARM CAUSED BY CREATOR CONTENT; LOSS ARISING FROM UNAUTHORISED

ACCOUNT ACCESS DUE TO YOUR FAILURE TO MAINTAIN SECURITY; LOSS FROM PLATFORM

DOWNTIME OR SERVICE INTERRUPTION; OR LOSS ARISING FROM YOUR RELIANCE ON ANY CREATOR'S REPRESENTATIONS.

10.6 Cap on Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FANFLOW'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO FANFLOW IN THE THREE

(3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10.7 Creator Disputes

Any dispute you have with a Creator is a matter between you and the Creator. FanFlow may at its discretion facilitate communication but bears no legal responsibility for the resolution of such disputes and is not liable for any losses you suffer as a result of a Creator's actions or omissions.

SECTION 11: FAN INDEMNIFICATION

11.1 Fan Indemnification Obligation

You agree to defend, indemnify, and hold harmless FanFlow, Inc., FanFlow Holdings, LLC, FanFlow Media LLC, and each of their respective officers, directors, shareholders, employees, agents, successors, and assigns (the "FanFlow Parties") from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

Your breach of any provision of these Fan Terms;

Your use of the Platform in violation of applicable law;

Any unauthorised reproduction, distribution, or commercialisation of Creator Content by you;

Any fraudulent payment activity, including use of stolen payment credentials;

Any bad-faith chargeback or payment dispute you initiate in circumstances where a refund would not bewarranted under these Terms;

Any harassment, threats, or abusive conduct directed by you toward a Creator or other User;

Any misrepresentation made by you to FanFlow, a Creator, or another User;

Any claim by a third party arising from your conduct on or through the Platform.

11.2 FanFlow's Right to Control Defence

FanFlow reserves the right to assume exclusive control of the defence of any matter for which you are required to indemnify FanFlow. You agree to cooperate with FanFlow's defence and not to settle any claim without FanFlow's prior written consent.

11.3 Survival of Indemnification

Your indemnification obligations survive termination of your account and these Fan Terms.

SECTION 12: PROHIBITED CONTENT ACCESS

12.1 Non-Circumvention

You must not attempt to access content tiers or features for which you have not paid, including by using technical exploits; using another person's account credentials; sharing subscription access with others; or using VPNs to circumvent geographic access restrictions.

12.2 Prohibited Content Viewing

Even if certain content becomes accessible due to technical error, you must not access, view, or download content that you reasonably know or suspect depicts a minor in a sexual context; was published without the consent of persons featured in it; or has been specifically restricted by FanFlow. If you encounter any such content, report it immediately at trust@fanflow.com without downloading or reproducing it.

12.3 No Access After Termination

Following termination of your account, you must immediately cease all access to the Platform and any Creator Content. Continued access after termination using another account or technical means is prohibited.

SECTION 13: PLATFORM AVAILABILITY AND MODIFICATIONS

13.1 Service Availability

FanFlow does not guarantee that the Platform will be available at all times. The Platform may experience downtime due to maintenance, system upgrades, or unforeseen technical issues. FanFlow will use reasonable efforts to minimise downtime and provide advance notice of scheduled maintenance.

13.2 Modifications to the Platform

FanFlow reserves the right to add, remove, or modify any feature or functionality at any time. Material changes that adversely affect your rights will be communicated with reasonable advance notice.

13.3 Modifications to These Fan Terms

FanFlow may modify these Fan Terms at any time. Material changes will be communicated by email or through a prominent notice on the Platform at least 14 days before taking effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

13.4 Discontinuation

If FanFlow permanently discontinues the Platform, FanFlow will use reasonable efforts to provide 30 days' advance notice, cancel all active subscriptions, and facilitate any applicable pro-rata refunds.

SECTION 14: DISPUTE RESOLUTION AND GOVERNING LAW

14.1 Governing Law

These Fan Terms are governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflicts of law principles. Nothing in this clause limits mandatory consumer protection laws in your jurisdiction that cannot be contractually excluded.

14.2 Informal Resolution

Before initiating formal legal proceedings, you agree to first attempt informal resolution by contacting FanFlow at legal@fanflow.com with a written description of your dispute, the relief sought, and your contact details. FanFlow will endeavour to respond within 30 days. Either party may proceed to formal dispute resolution if the matter is not resolved within 45 days.

14.3 Binding Arbitration

SUBJECT TO SECTION 14.5, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING

TO THESE FAN TERMS OR YOUR USE OF THE PLATFORM SHALL BE RESOLVED BY FINAL AND

BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION

("AAA") UNDER ITS CONSUMER ARBITRATION RULES, RATHER THAN IN A COURT OF LAW. YOU

ACKNOWLEDGE THAT YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION PROCEEDINGS.

14.4 Class Action Waiver

ALL CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY. YOU AGREE NOT TO PARTICIPATE

AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING AGAINST FANFLOW.

14.5 Exceptions to Arbitration

The mandatory arbitration obligation does not apply to: claims for urgent injunctive or equitable relief to prevent imminent irreparable harm; claims that may be brought in small claims court; or claims where mandatory arbitration is prohibited by applicable consumer protection law in your jurisdiction.

14.6 Statute of Limitations

Any claim or cause of action against FanFlow arising from these Terms or your use of the Platform must be commenced within one (1) year of the date on which the claim arose, or it will be permanently barred.

14.7 Consumer Rights Preservation

For Fans located in the European Union, United Kingdom, Australia, or other jurisdictions with mandatory consumer protection laws, nothing in this Section 14 limits your right to bring a complaint before your local consumer protection authority or equivalent body.

SECTION 15: ACCOUNT TERMINATION

15.1 Termination by You

You may terminate your Fan account at any time via Account Settings by selecting "Delete Account." Deletion will cancel all active subscriptions at the end of their current billing period. You will not be entitled to a refund for unused portions of current subscriptions unless otherwise provided in the Refund Policy.

15.2 Termination by FanFlow

FanFlow may terminate or suspend your account immediately and without prior notice for: any material breach of these Fan Terms; fraudulent activity including bad-faith chargebacks; redistribution or copyright infringement of Creator Content; harassment, threats, or abuse directed at Creators or other Users; or any conduct FanFlow reasonably determines poses a risk to Platform safety or integrity.

15.3 Effect of Termination

Upon termination: all active subscriptions are cancelled; access to all Creator Content ceases immediately; FanFlow may retain your data as required by law; outstanding indemnification obligations survive; you will not be entitled to any refund if termination is due to your breach; and Sections 8, 11, 14, 15, and 16 survive termination.

15.4 Re-Registration After Termination

If your account is terminated by FanFlow for breach of these Terms, you may not re-register without FanFlow's prior written consent. Circumventing a ban through new account registration constitutes a further breach of these Terms.

SECTION 16: GENERAL PROVISIONS

16.1 Entire Agreement

These Fan Terms, together with the Privacy Policy, Community Guidelines, and any other policies incorporated by reference, constitute the entire agreement between you and FanFlow with respect to your use of the Platform as a Fan.

16.2 Severability

If any provision of these Fan Terms is found to be invalid, unlawful, or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it will be severed. The remaining provisions will continue in full force.

16.3 No Waiver

FanFlow's failure to enforce any provision of these Fan Terms on any occasion does not constitute a waiver of its right to enforce that provision on any other occasion.

16.4 Assignment

You may not assign your account, rights, or obligations under these Fan Terms without FanFlow's prior written consent. FanFlow may freely assign its rights and obligations, including in connection with a merger, acquisition, or sale of assets.

16.5 Force Majeure

FanFlow shall not be in breach of these Fan Terms and shall not be liable to you for any failure or delay caused by circumstances beyond its reasonable control, including acts of God, natural disasters, pandemics, internet infrastructure failures, cyberattacks, government actions, or failures of third-party service providers.

16.6 Independent Parties

FanFlow and you are independent parties. Nothing in these Fan Terms creates an employment, agency, partnership, or joint venture relationship between you and FanFlow.

16.7 Notices

FanFlow will send notices to you at the email address registered to your account. You are responsible for keeping your contact information current. Notices to FanFlow must be submitted to legal@fanflow.com.

16.8 Electronic Communications Consent

By creating an account, you consent to receive electronic communications from FanFlow including transactional emails, subscription receipts, renewal reminders, policy update notices, and service announcements. You may opt out of non-essential marketing communications at any time through your account preferences.

16.9 Language

These Fan Terms are executed in the English language. In the event of any inconsistency between the English version and any translation, the English version shall prevail.

SECTION 17: CHILD SAFETY

17.1 Absolute Prohibition

FanFlow has a zero-tolerance policy toward child sexual abuse material (CSAM) and any content that sexualises, exploits, or endangers minors. If you encounter any such content on the Platform, you must not download, save, share, or interact with it in any way; report it immediately using the Platform's reporting tools or by emailing safety@fanflow.com; and preserve any information that may assist FanFlow and law enforcement in investigating the matter.

17.2 Mandatory Reporting

FanFlow will report any known or suspected CSAM to the National Center for Missing and Exploited Children (NCMEC) and relevant law enforcement authorities as required by 18 U.S.C. § 2258A. Users who knowingly access, distribute, or possess such material may face criminal prosecution.

SECTION 18: FANFLOW AFTER DARK — FAN PROVISIONS

18.1 Separate Platform

FanFlow After Dark (fanflowafterdark.com) is a legally separate adult content platform operated by FanFlow Media LLC. Access is subject to these Fan Terms and the FanFlow After Dark Supplemental Fan Terms, which you must accept separately.

18.2 Mandatory Age Verification

Access to FanFlow After Dark requires completion of mandatory age verification, including: credit card verification confirming the cardholder is at least 18 years of age; government-issued photo ID verification via FanFlow's third-party provider; two-factor authentication at each login; and re-verification every 90 days. Attempting to circumvent age verification is a serious breach of these Terms and may constitute a criminal offence.

18.3 Fan Acknowledgment for Adult Content

By accessing FanFlow After Dark, you represent and warrant that you are at least 18 years of age; you are accessing adult content voluntarily for personal use; adult content is legal to access in your jurisdiction; and you will not permit any minor to access any device through which you are logged in to FanFlow After Dark.

18.4 Enhanced Privacy for After Dark

FanFlow applies additional privacy protections to After Dark subscriber data. Your subscription history on After Dark will not be disclosed to third parties except as strictly required by law. You acknowledge that FanFlow maintains records of your After Dark subscriptions and transactions as required for tax, fraud prevention, and legal compliance purposes.

18.5 Reporting After Dark Content

If you encounter any content on FanFlow After Dark that you believe is unlawful — including content featuring minors or non-consensual acts — report it immediately at trust@fanflowafterdark.com or trust@fanflow.com.

SECTION 19: ACCESSIBILITY, COMPLAINTS, AND SUPPORT

19.1 Fan Support

FanFlow provides Fan support via: Email: support@fanflow.com | Help centre: fanflow.com/help | In-app support ticket system (available from your account dashboard). FanFlow endeavours to respond to support requests within 5 business days. Urgent safety and legal matters will be prioritised.

19.2 Formal Complaints

Submit a formal complaint to support@fanflow.com with the subject line "Formal Complaint." FanFlow will acknowledge your complaint within 3 business days and provide a substantive response within 21 days.

19.3 Regulatory Complaints

If your complaint is not resolved through FanFlow's internal process, you may escalate to the relevant regulatory or consumer protection authority in your jurisdiction. FanFlow's internal complaints process does not limit your right to contact regulators.

19.4 Accessibility

SECTION 20: SPECIFIC COUNTRY PROVISIONS

20.1 European Union and European Economic Area

If you are accessing the Platform from within the EU/EEA: you have the right to withdraw from digital content purchases within 14 days unless content has been made available and you have acknowledged waiver of this right at the time of purchase; mandatory arbitration and class action waiver may not apply to you under applicable EU consumer law; you have GDPR rights including access, rectification, erasure, and portability, and you may lodge a complaint with your local data protection authority; and FanFlow's processing of your personal data is governed by EU Standard Contractual Clauses where applicable.

20.2 United Kingdom

If you are accessing the Platform from the United Kingdom: your consumer rights under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013 are preserved; FanFlow processes your personal data in compliance with the UK GDPR and Data Protection Act 2018; and you may refer complaints to the UK Information Commissioner's Office (ICO) in relation to FanFlow's data handling practices.

20.3 Australia

If you are accessing the Platform from Australia: your rights under the Australian Consumer Law are preserved, including consumer guarantees that cannot be excluded; FanFlow processes your personal data in compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles; and disputes may be referred to the Office of the Australian Information Commissioner (OAIC) for privacy matters.

20.4 California

If you are a California resident: you have rights under the CCPA/CPRA including the right to know what personal information is collected, to request deletion, to opt-out of the sale or sharing of personal information, and to non-discrimination for exercising your rights; FanFlow does not sell your personal information as defined under the CCPA; and you may submit CCPA requests to privacy@fanflow.com.

BY CREATING AN ACCOUNT, SUBSCRIBING TO ANY CREATOR, OR MAKING ANY PAYMENT ON THE

FANFLOW PLATFORM, YOU CONFIRM THAT: YOU ARE AT LEAST 18 YEARS OF AGE; YOU HAVE READ

AND UNDERSTOOD THESE FAN TERMS IN THEIR ENTIRETY; YOU AGREE TO BE LEGALLY BOUND BY

THESE FAN TERMS; YOU UNDERSTAND THAT THESE TERMS CONTAIN A BINDING ARBITRATION

CLAUSE AND CLASS ACTION WAIVER IN SECTION 14; AND YOU HAVE HAD THE OPPORTUNITY TO SEEK INDEPENDENT LEGAL ADVICE BEFORE AGREEING TO THESE TERMS.
